Children of homosexual couples can have two mothers, Beppe Sala: "A positive ruling"

Milan – “The ruling of the Constitutional Court seems to me to be a good step, also because being a requirement, what did mothers do first? They tried the path of adoption, which is a difficult path. This thing simplifies a lot, therefore, from my point of view, I agree”. This is the comment of Giuseppe Sala regarding the ruling of the Constitutional Court that on Thursday established and recognized the right of the children of lesbian couples to have two mothers even before the law.

“It’s not that if you can’t do it, you give up doing it, especially with procreation : you do it anyway. And then it just becomes more complex to manage the boy or girl, I think that’s a positive thing ,” added the mayor.

Children born into rainbow families, the Constitutional Court has decided, cannot remain in a legal limbo . The case is a classic one: two women marry abroad, one of them gives birth to a child conceived through assisted fertilization, but in Italy only the biological mother is listed as a parent . The other remains unknown to the registry office, even if in fact she raises the child every day.

“The best interests of the minor prevail over everything,” wrote the constitutional judges. Translated: no matter what legislators think of homoparental families, a child has the right to have all of his stable affective ties recognized .

The decision does not revolutionise the Italian regulatory landscape – stepchild adoption remains the only way to legal recognition – but it forces courts to consider the situation of these minors on a case-by-case basis. For LGBTQ+ associations, it is a partial but important victory. “Finally, it is recognized that we exist,” commented Famiglie Arcobaleno. On the other hand, traditionalist movements speak of a “distortion of the natural family.”
